1. Introduction

Welcome to JustAsk WP™ (the ”Plugin“ or ”Service“), a WordPress AI-powered chat plugin provided by Chatman Design LLC (”Company“, ”we“, ”us“, or ”our“).

These Terms of Service (”Terms“) govern your subscription to and use of the Plugin. By signing up for a trial, purchasing a subscription, installing, or using the Plugin, you agree to these Terms. If you do not agree, do not use the Service.

2. Subscription and Free Trial

• The Service is offered on a subscription basis.
• A free trial period is available for new users (duration specified at signup). The trial converts to a paid subscription automatically unless you cancel before it ends.
• Subscriptions automatically renew at the end of each billing cycle (monthly or annual) unless canceled.
• All fees are non-refundable except where required by law. You are responsible for keeping your payment information current.

3. License Grant

Subject to your active subscription, payment of fees, and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Plugin on a single WordPress website that you own or control.

• No multisite licensing is included. Use on multiple sites or WordPress multisite networks requires separate licenses for each site.
• You may not resell, sublicense, rent, lease, distribute, or commercially exploit the Plugin.
• You may not reverse engineer, decompile, or modify the core Plugin code (except as allowed by WordPress standards).

4. Acceptable Use and Responsibilities

You agree to use the Service only for lawful purposes. You and your end users take full responsibility for all usage of the Plugin and any content it generates.

Prohibited Uses (you will not, and will not allow others to):

• Use the Service for any illegal, fraudulent, harmful, abusive, harassing, discriminatory, or defamatory purpose.
• Generate or distribute content that violates laws, infringes intellectual property rights, or promotes violence, hate, spam, or exploitation.
• Attempt to bypass safety mechanisms, rate limits, or use the Service to train competing AI models.
• Share your license key or allow unauthorized access.

AI-Specific Acknowledgements:

• The Plugin uses third-party artificial intelligence models. AI outputs can contain errors, inaccuracies, biases, or hallucinations — just as humans can make mistakes.
• You acknowledge that we do not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated responses.
• You assume all risks and take full responsibility for reviewing, verifying, and using any outputs on your website. We are not liable for any decisions, actions, or damages resulting from reliance on the Service.

5. Intellectual Property

• The Plugin, its code, design, and all related materials are owned by the Company or its licensors.
• You retain ownership of your inputs. You grant us a royalty-free license to use anonymized data to improve the Service.
• Outputs are provided for your use, subject to third-party AI provider terms.

6. Data and Privacy

Please review our Privacy Policy. You are solely responsible for complying with privacy laws (e.g., GDPR, CCPA) regarding data collected from your website visitors, including any data sent to AI providers.

7. Disclaimers

THE SERVICE IS PROVIDED ”AS IS“ AND ”AS AVAILABLE“ WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLUGIN OR AI OUTPUTS WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR SECURE.

We expressly disclaim all liability for any errors, omissions, or inaccuracies in AI-generated content.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS) ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

Our total liability to you shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

9. Termination and Suspension

• Let me know if you have any feedback or thoughts on anything.
• We may suspend or terminate your access immediately for violation of these Terms, non-payment, or to protect the Service.
• Upon termination, you must remove the Plugin from your site.

10. Governing Law

These Terms are governed by the laws of State of Wisconsin, United States, without regard to conflict of laws rules. Disputes shall be resolved exclusively in the courts located in your county and state.

11. Miscellaneous

• These Terms constitute the entire agreement between you and the Company.
• If any provision is held invalid, the remainder remains enforceable.
• We may assign these Terms; you may not without our prior written consent.
